In a recent commentary, former Manchester Republican Committee Chair Perry Green claimed Donald Trump had declassified the documents he stored at his Florida mansion. Green wrote, “Stop, don't make false determinations based on misinformation by the mainstream media reporting.”

Mr. Green is the one peddling misinformation, however. If he would look at what Trump's own lawyers have said, he would realize his mistake. On Sept. 20, Reuters reported: “Donald Trump's lawyers resisted revealing whether he declassified materials seized in an FBI search of his Florida home as the judge appointed to review the documents planned his first conference on the matter on Tuesday.”

"As U.S. District Judge Aileen M. Cannon ruled twice in the Mar-a-Lago documents case for the former president who nominated her to the bench, many legal experts — including conservatives and executive-power advocates — have strained to understand how she could have reached such conclusions about Donald Trump’s claims.

On Wednesday night, two fellow Trump nominees joined with another judge to provide the rebuke of Cannon’s jurisprudence that those experts suggested might be coming.

A three-judge panel of the U.S. Court of Appeals for the 11th Circuit was rather unsparing in unanimously granting the Justice Department a reprieve from Cannon’s order barring them from reviewing documents with classified markings seized from Mar-a-Lago. The stay is temporary, but the reasoning is firm.

They repeatedly rejected not just the Trump legal team’s lack of arguments, but also Cannon’s acceptance of them. Indeed, they suggested it was inexplicable that Cannon ruled for Trump even by her own logic.

The ruling really kicks into gear when the judges address what a 1977 Supreme Court case considered the “foremost consideration” in deciding whether a court such as Cannon’s should exercise jurisdiction in such a case: whether the government “displayed a callous disregard for … constitutional rights” in its seizure.

The judges say Cannon conceded that it hadn’t displayed such disregard, but then disregarded that consideration all the same — and say she thus “abused” her “discretion.”

“Here, the district court concluded that [Trump] did not show that the United States acted in callous disregard of his constitutional rights. No party contests the district court’s finding in this regard,” the judges write. “The absence of this ‘indispensab[le]’ factor … is reason enough to conclude that the district court abused its discretion in exercising equitable jurisdiction here.”

The judges continue, rather dryly: “But for the sake of completeness, we consider the remaining factors.”

Cannon might wish they hadn’t.

On the second test — whether Trump has an interest in the documents marked classified at issue — the judges note that Cannon ruled Trump had an interest in some of the documents seized.

“But none of those concerns apply to the roughly one-hundred classified documents at issue here,” the judges write, before twisting the knife a little more: “And the district court made no mention in its analysis of this factor as to why or how Plaintiff might have an individual interest in or need for the classified documents.”- Washington Post today. "A U.S. House of Representatives committee said on Thursday that it was investigating the Saudi Arabian government's $2 billion investment with a firm of Jared Kushner, the son-in-law of former President Donald Trump.

"The Committee on Oversight and Reform is investigating whether you (Kushner) have improperly traded on your government position to obtain billions of dollars from the Saudi government and whether your personal financial interests improperly influenced U.S. foreign policy during the administration of your father-in-law, former President Trump," Representative Carolyn Maloney, the New York Democrat who leads the House Committee on Oversight and Reform, said on Thursday in a letter.

Maloney sent the letter to Kushner, who served as a White House adviser to Trump, requesting documents on the investment in his firm, A Fin Management LLC (Affinity).

In a typical private equity investment, Saudi Arabia would have put money into a fund managed by A Fin, rather than investing in the firm itself. The details of this investment were not known.

"Your support for Saudi interests was unwavering, even as Congress and the rest of the world closely scrutinized the country’s human rights abuses in Yemen, the murder of journalist Jamal Khashoggi by Saudi assassins tied to Crown Prince Mohammed bin Salman, and Saudi Arabia’s crackdown on political dissidents at home," Maloney wrote in the letter.

Kushner incorporated the firm after Trump left office and it secured the $2 billion investment from Saudi Arabia six months later, Maloney added."

There was the Westchester County golf club valued as if it had charged hefty initiation fees that were never actually collected; the “cash” that Mr. Trump counted even though it belonged to one of his business partners; and the pretense that his Mar-a-Lago club and his golf course in Scotland could make money from building homes on the properties, even though the Trumps had agreed to limit such development.

In yet another example cited in the case, the Trump Organization starkly overvalued a group of rent-stabilized apartments in Trump Park, its building on Park Avenue — apartments that Donald Trump Jr. once described as being “the bane” of his existence.
