OCCUPANTS OF: 51 Route 14 South, Randolph VT MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered October 16, 2018 in the above captioned action brought to foreclose that certain mortgage given by Stephen E. Farnum and Marsha Delaine Farnum n/k/a M. Delaine Sapp to Mortgage Electronic Registration Systems, Inc., as nominee for Suntrust Mortgage, Inc., dated July 6, 2007 and recorded in Book 166 Page 209 of the land records of the Town of Randolph, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for Suntrust Mortgage, Inc. to Wilmington Savings Fund Society, FSB, as trustee of Upland Mortgage Loan Trust A dated August 8, 2017 and recorded in Book 205 Page 587 of the land records of the Town of Randolph for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 51 Route 14 South, Randolph, Vermont on January 22, 2019 at 10:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same land and premises conveyed to Stephen E. Farnum and Marsha Delaine Farnum by warranty deed of Christopher William Rumrill and Krista Rachael Rumrill DATED December 21, 2005 and recorded in Book 158 at pages 460 - 461 of the Randolph land records. Being all and the same land and premises conveyed to Christopher William Rumrill and Krista Rachael Rumrill by the warranty deed of Raymond K. Cunningham, Jr., and Christine Marie Cunningham dated August 14, 1997 and recorded in Book 123, at Pages 616-617 of the Randolph land records. Being a parcel of land estimated to contain 2 acres, to be the same, more or less, with dwelling house and other improvements thereon standing, all located on the easterly side of Vermont State Route 14 in the settlement of East Randolph and being all and the same land and premises conveyed to the herein grantor by warranty deed of Raymond K. Cunningham and Lolamae Cunningham dated December 13, 1990 and recorded at Book 104, Page 321 of the Randolph land records, where it is more particularly described as follows: "The parcel being conveyed hereby is bounded and described as COMMENCING at a point on the easterly side of Vermont State Route 14 which point marks the southwesterly corner of the parcel herein conveyed and the northwesterly corner of lands and premises now of Henry and Lyn Dantzig (Book 79, Page 333 of the Randolph land records); THENCE proceeding in an easterly direction on the common boundary separating these premises on the north from that of Dantzig on the south a distance of 537 feet, more or less, to an iron pin set at the intersection of wire fences which iron pin marks the southeasterly corner of the within conveyed premises and the northeasterly corner of the said Dantzig property; THENCE turning an angle to the left and proceeding northerly along the wire fence marking the dividing line between the within conveyed parcel on the west from lands conveyed by these Grantors to Heyder on the east (Book 98, Page 442-443) north 4 degrees 30 minutes east a distance of 150 feet, more or less, to an unmarked point; THENCE turning an angle to the left and proceeding on the line dividing the within conveyed premises on the south from the above described parcel conveyed to Heyder on the north, north 82 degrees 30 minutes west a distance of 427 feet to an unmarked point; THENCE turning an angle slightly to the left and proceeding westerly on the line dividing the within conveyed premises on the south from lands now of Weyant on the north (Book 99, Page 482) to a point in the easterly edge of the right-of-way of Vermont State Route 14 which point marks the northwesterly corner of the within conveyed premises and the southwesterly corner of lands of said Weyant; THENCE turning an angle to the left and proceeding southerly along the easterly edge of Vermont State Route 14 a distance of 150 feet, more or less, to the point and place of BEGINNING." These lands are conveyed subject to utility line and other easements and right-of-way and other rights and interest of record including that utility line easement and right-of-way granted Central Vermont Public Service and New England Telephone and Telegraph Company by the deed of Cunningham dated February 17, 1988 and of record in Book C, at Page 337 of the Randolph land records. The premises are also conveyed subject to the rights of the State of Vermont to maintain its right-of-way which forms the westerly edge of the within conveyed parcel which rights are more particularly set forth in the deed of record in Book 96, at Page 292 of the Randolph land records. Reference is hereby made to the aforesaid deeds and records, the deeds and records referred to therein and the Randolph land records in aid of this description. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
