In accordance with the Judgment Order and Decree of Foreclosure entered October 31, 2019, in the above captioned action brought to foreclose that certain mortgage given by Carmella Cyr to Chase Manhattan Mortgage Corporation, dated August 31, 1998 and recorded in Book 127 Page 210 of the land records of the Town of Randolph and recorded in Book 76 Page 349 of the land records of the Town of Bethel, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Chase Manhattan Mortgage Corporation to Citibank, N.A., as trustee dated October 21, 1998 and recorded in Book 132 Page 206 and in Book 199 Page 317; (2) Assignment of Mortgage from CitiBank, National Association as Trustee to NRZ Pass-Through Trust IV, U.S. Bank National Association as Trustee dated October 20, 2014 and recorded in Book 195 Page 649 and in Book 112 Page 80; (3) Assignment of Mortgage from to NRZ Pass-Through Trust IV, U.S. Bank National Association as Trustee to Pretium Mortgage Credit Partners I Loan Acquisition, LP dated June 23, 2015 and recorded in Book 199 Page 317 and in Book 112 Page 75; and (4) Assignment of Mortgage from Pretium Mortgage Credit Partners I Loan Acquisition, LP to Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust, not individually but as Trustee for Pretium Mortgage Acquisition Trust dated July 1, 2015 and recorded in Bok 199 Page 320 and in Book 112 Page 81, all of the land records of the Town of Randolph and Bethel respectively for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1781 Tatro Hill Road, Randolph and Bethel, Vermont on December 18, 2019 at 9:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same land and premises conveyed to Carmella Cyr by Warranty Deed of Lucas B. Adler and Christine Adler of even or approximately even date hereof and which Deed is about to be to be recorded in the Town of Randolph and then Bethel Land Records. Consisting of two parcels further described as follows: 1. Being all and the same land and premises conveyed to Lucas B. Adler by Warranty Deed of Mark A. Adams, Anne Adams, Morgan A. Adams and Ruth E. Adams dated May 27, 1992 and of record in Volume 108 at Pages 91-92 of the Town of Randolph Land Records. Being a parcel of land estimated to contain 16 acres, more or less, with a dwelling house thereon, located on Tatro Hill Road. 2. Being all and the same land and premises conveyed to Lucas B. Adler and Christine B. Adler by Warranty Deed of Mark A. Adams, Anne Adams, Morgan A. Adams and Ruth E. Adams dated January 2, 1997 and of record in Volume 74 at Page 88 of the Bethel Land Records. Being a parcel of land containing 28 acres, more or less contiguous to parcel 1. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale.
