In accordance with the Judgment Order and Decree of Foreclosure entered October 16, 2018 in the above captioned action brought to foreclose that certain mortgage given by Ruth C. Skinner aka Ruth Coleman Skinner to Financial Freedom Senior Funding Corporation, a Subsidary of IndyMac Bank, F.S.B., dated September 10, 2004 and recorded in Book 115 Page 488 of the land records of the Town of Danville, of which mortgage the Plaintiff is the present holder, 1) by virtue of an Assignment of Mortgage to Mortgage Electronic Registration Systems, Inc. as nominee for Financial Freedom Acquisition LLC dated October 25, 2009 and recorded in Book 137 Page 481 of the land records of the Town of Danville and 2) by virtue of an Assignment of Mortgage to Secretary of Housing and Urban Development dated May 24, 2010 and recorded in Book 139 Page 560 of the land records of the Town of Danville, 3) by virtue of an Assignment of Mortgage to U.S. Bank National Association, not in its individual capacity but solely as trustee for the RMAC Trust, Series 2016-CTT dated November 20, 2017 and recorded in Book 161 Page 705 of the land records of the Town of Danville for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 155 Brainerd Street, Danville, Vermont on January 15, 2019 at 11:30 AM all and singular the premises described in said mortgage, To wit: Exhibit A to the Mortgage given on SEPTEMBER 10, 2004, by RUTH C. SKINNER ("Borrower'') to Financial Freedom Senior Funding Corporation, a Subsidiary of IndyMac Bank, F.S.B. ("Lender"). The Property is located in the county of CALEDONIA, state of VERMONT, described as follows: Being a parcel of land said to contain one acre, more or less, together with the dwelling house and any other improvements thereon, situated on the northeasterly side of State Aid Highway 11, known as Brainard Street in the Village of Danville Green; and Being all and the same lands and premises conveyed to Raymond J. Skinner (previously deceased) and Ruth C. Skinner, as tenants by the entirety, by David A. Currier and Ernest Tobias Balivet, Co-Guardians of Marjorie E. Currier, by Guardian's Deed dated May 25, 1990 and May 18, 1990 and recorded on July 19, 1990 in Book 77 at Pages 530-532 of the Danville Land Records. Said premises are further described as all of the same lands and premises conveyed to Marjorie E. Currier by the Probate Court -Caledonia District from the Estate of Kate A. Currier by its Decree of Distribution dated August 14, 1961 and recorded in Book 43 at Page 554 of the Danville Land Records. Reference may be had to the aforementioned deeds and the record and reference thereof, and to all prior deeds and their records, for a more particular description of the lands and premises herein conveyed. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale.
