In accordance with the Judgment Order and Decree of Foreclosure entered April 12, 2018, in the above captioned action brought to foreclose that certain mortgage given by the late Gary S. Hicks to United Companies Lending Corporation, dated September 27, 1995 and recorded in Book 119 Page 2 of the land records of the Town of Randolph, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from United Companies Lending Corporation to Bankers Trust Company of California, N.A. dated June 25, 1996 and recorded in Book 121 Page 183; (2) Assignment of Mortgage from Bankers Trust Company of California, N.A. to United Companies Lending Corporation dated September 26, 1996 and recorded in Book 122 Page 14; (3) Assignment of Mortgage from United Companies Lending Corporation to EMC Mortgage Corporation dated July 20, 2000 and recorded in Book 134 Page 539; (4) Assignment of Mortgage from EMC Mortgage LLC f/k/a EMC Mortgage Corporation to U.S. Bank National Association, as Trustee, Successor in Interest to Bank of America, National Association as successor by merger to LaSalle Bank National Association as Trustee for certificateholders of EMC Mortgage Loan Trust 2003-B, Mortgage Loan Pass-Through Certificates, Series 2003-B dated September 11, 2012 and recorded in Book 188 Page 246; and (5) Corrective Assignment of Mortgage from EMC Mortgage LLC f/k/a EMC Mortgage Corporation to U.S. Bank National Association, as Trustee, Successor in Interest to Bank of America, National Association as Trustee as successor by merger to LaSalle Bank National Association as Trustee for certificateholders of EMC Mortgage Loan Trust 2003-B, Mortgage Loan Pass-Through Certificates, Series 2003-B, dated June 20, 2013 and recorded in Book 191 Page 493, all of the land records of the Town of Randolph for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 10 Emerson Terrace, Randolph, Vermont on April 2, 2019 at 10:00AM all and singular the premises described in said mortgage, To wit: Being a certain piece of land in the Town of Randolph, County of Orange, and State of Vermont, more particularly described as follows: Being a lot of land with dwelling house thereon, situated at 10 Emerson Terrace, formerly known as Terrace Street, in the former Village of Randolph, and being all and the same land and premises conveyed to Gary S. Hicks by the Warranty Deed of David F. Huntley a/k/a David H. Huntley and Dianna J. Chan, f/k/a Dianna J. Huntley to Gary S. Hicks dated September 30, 1991 and recorded in Book 106, Pages 251-252 of the Randolph Land Records. Said land and premises are further described as being Lot #5 on a certain plan of lots entitled "Plat of Land deeded by Charles H. Bass to E.F. Emerson and W.C. Emerson November 20, 1903 H.W. McIntyre Surveyor May 1904 Street relocated 1907 and lots changed and renumbered", recorded with the deed in Book 33, Page 367, this being the second map attached to the record of said deed. Reference is hereby made to the aforementioned deed, to the deeds mentioned therein and to the Town of Randolph Land Records in aid of this description. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale.
