In accordance with the Judgment Order and Decree of Foreclosure entered August 3, 2018, in the above captioned action brought to foreclose that certain mortgage given by Michael Floyd Davis and Stacy L. Davis to Mortgage Electronic Registration Systems, Inc., as nominee for USAA Federal Savings Bank, dated July 24, 2009 and recorded in Book 84 Page 100 of the land records of the Town of Marshfield, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for USAA Federal Savings Bank to U.S. Bank National Association dated July 25, 2016 and recorded in Book 95 Page 572 of the land records of the Town of Marshfield for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1719 VT Route 232, Marshfield, Vermont on May 6, 2019 at 11:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises conveyed to Michael Floyd Davis and Stacy L. Davis by Deed of Federal National Mortgage Asso of approximate even date herewith and to be recorded in the Town of Marshfield Land Records. Said lands and premises being more particularly described as follows: Being all and the same lands and premises acquired by Federal National Mortgage Association by virtue of the following: 1. A Certificate of Non-Redemption and certified Judgment Order and Decree of Foreclosure in a cause entitled: Chase Home Finance, LLC v. Marion L. Haycook, Washington Superior Court Docket No. 50-1-08 Wncv, which Certificate is dated October 23, 2008 and recordd in Volume 81, Page 384 of the Town of Marshfield Land Records; and 2. Confirmation Order issued by the Washington Superior Court in the matter of Chase Home Finance, LLC v. Haycock, Docket No. 50-1 -08 Wncv dated January 16, 2009 and recorded at Book 82, Page 185 of the Town of Marshfield Land Records and further described as follows: Being all and the same lands and premises conveyed to Robert J. Haycook, Sr. and Marion L. Haycook by Warranty Deed of Jodi A. Hardy and Thomas D. Hardy dated September 26, 2005 and recorded at Book 72, Page 526 of the Town of Marshfield Land Records. Being all and the same lands and premises conveyed to Jodi A. Hardy and Thomas D. Hardy by Warranty Deed of Jeanette Shaffer dated June 24, 1999 and recorded in Book 53, Page 136 of the Marshfield Land Records. Being all and the same land and premises conveyed to Jeanette Shaffer by Warranty Deed of Bill F. Chamberlain and Mary Chamberlain dated April 5, 1984, and of record in Book 34, Page 435 of the Town of Marshfield and Records: Being all of two separate parcels of land and premises conveyed to Bill F. Chamberlain and Mary Chamberlain by Warranty Deed of Cecil F. Chamberlain and Katherine W. Chamberlain dated October 8, 1967, and of record in Book 28, Page 223B, and by Warranty Deed of Morin Smith and Velma Smith dated May 17, 1977, and of record in Book 32, Page 9 of the Marshfield Land Records. Said property is with the benefit of any spring rights, easements for ingress and egress, and rights incident to each of the same as may appear more particularly of record. Any portion of the described land and premises which lies within the right of way of Vermont State Highway #232 was conveyed by quitclaim only. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
