In accordance with the Judgment Order and Decree of Foreclosure entered August 2, 2018, in the above captioned action brought to foreclose that certain mortgage given by David Scott Bergholm to Mortgage Electronic Registrations Systems, Inc., as nominee for Plaza Home Mortgage, Inc., dated November 4, 2011 and recorded in Book 52 Page 148 of the land records of the Town of West Fairlee, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc, as nominee for Plaza Home Mortgage, Inc. to Plaza Home Mortgage, Inc. dated December 15, 2015 and recorded in Book 55 Page 131 and (2) Assignment of Mortgage from Plaza Home Mortgage, Inc. to Nationstar Mortgage, LLC d/b/a Mr. Cooper dated November 5, 2018 and recorded in Book 57 Page 160, both of the land records of the Town of West Fairlee for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 2848 Vt Route 244, West Fairlee, Vermont on August 2, 2019 at 10:00 AM all and singular the premises described in said mortgage, To wit: Meaning and intending to mortgage and convey the lands and premises as conveyed, to David Scott Bergho1m by deed of Derith Sutherland dated November 2, 2011 and recorded on November 9, 2011 at Volume 52, Page 146 of the Land Records of the Town of West Fairlee. The Property is described in that deed as follows: "Being a parcel of land with the buildings and improvements thereon, designated as 2848 VT Route 244 in the Town of West Fairlee, and being all and the same lands and premises conveyed to Derith Sutherland and Leona Sutherland, mother and daughter, by Warranty Deed of Mae Hill dated October 9, 1969 and recorded in Volume 19, Page 231 of the Land Records of West Fairlee Land Records. "Reference is also made to the Warranty Deed from Leona Sutherland to Derith Sutherland dated December 3, 1984 and recorded in Book 24, Page 361 of the Land Records of the Town of West Fairlee Land Records, wherein said premises are described in part as follows: "Being a parcel of land with the buildings thereon standing situated on the westerly side of Vermont State Highway Route 113 and being more particularly bounded and described as follows: "Commencing at a point where the West Fairlee/Fairlee town line crosses said highway which point is marked by an iron post set in the ground; thence running in a westerly direction along said West Fairlee/Fairlee town line, a distance of 105 feet; thence turning an angle to the right and running in a northerly direction parallel to said Vermont State Highway Route No. 113, a distance of 250 feet to a point marked by an iron post set in the ground; thence turning an angle to the right and running in an easterly direction a distance of 150 feet to the westerly bound of said Vermont State Highway Route No. 113 which point is marked by an iron post driven in the ground; thence turning an angle to the right and running in a southerly direction along the westerly side of said Vermont State Highway Route No. 113, a distance of approximately 300 feet to the point begun at. The south, west and north line of said property are marked by a wire fence. Reference is also made to the Warranty Deed from Russell W. and Alberta H. Bragg to Mae Hill dated November 8, 1968 and recorded in Book 19, Page 134 of the West Fairlee Land Records." Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
