FISK OCCUPANTS OF: 24 Ainsworth Road, Woodbury VT MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered September 11, 2019, in the above captioned action brought to foreclose that certain mortgage given by Nathan R. Fisk and Francesca M. Fisk to Summit Financial Center, Inc., dated December 12, 2006 and recorded in Book 60 Page 355 of the land records of the Town of Woodbury, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Summit Financial Center, Inc. to Mortgage Electronic Registrations Systems, Inc., as nominee for Mortgage Network, Inc. dated December 12, 2006 and recorded in Book 60 Page 368; (2) Corrective Assignment of Mortgage from Summit Financial Center, Inc. to Mortgage Electronic Registrations Systems, Inc., as nominee for Mortgage Network, Inc. dated December 12, 2006 and recorded in Book 60 Page 527; (3) Assignment of Mortgage from Mortgage Electronic Registrations Systems, Inc., as nominee for Mortgage Network, Inc. to Green Tree Servicing, LLC dated June 17, 2013 and recorded in Book 70 Page 166; and (4) Assignment of Mortgage from Ditech Financial, LLC, successor buy merger to Green Tree Servicing, LLC to MTGLQ Investors, L.P. dated September 19, 2016 and recorded in Book 74 Page 211, all of the land records of the Town of Woodbury for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 24 Ainsworth Road, Woodbury, Vermont on December 4, 2019 at 11:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises as were conveyed to Francesca Fisk and Nathan R. Fisk by Warranty Deed of Mark A. Heath and Elaine M. Heath, which deed is of even or approximate date hereof and which is to be recorded in Woodbury, Vermont Land Records. Being further described as Being all and the same lands and premises as were conveyed to Mark A. Heath and Elaine M. Heath by warranty deed of Geraldine T. Wills, which deed is dated August 1, 2000, and which is of record at Book 49, Page 62 of the Land Records of the Town of Woodbury, Vermont. Reference may be made to the aforementioned deeds and to their records, and to all prior deeds and to their respective records, for a more complete and particular description of the land and premises herein conveyed. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
