In accordance with the Judgment Order and Decree of Foreclosure entered May 24, 2018 in the above captioned action brought to foreclose that certain mortgage given by Paul J. Cayia and Tammy J. Cayia to Mortgage Electronic Registration Systems, Inc. as nominee for Fieldstone Mortgage Company, dated September 22, 2006 and recorded in Book 220 Page 781-796 of the land records of the Town of Barre, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. as nominee for Fieldstone Mortgage Company to HSBC Bank USA, National Association, as Trustee of the Fieldstone Mortgage Investment Trust, Series 2006-3 dated December 18, 2012 and recorded in Book 0265 Page 0529 of the land records of the Town of Barre for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 120 Cheney Road, Barre, Vermont on January 21, 2019 at 11:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises conveyed to Tammy J. Cayia and Paul H. Cayia by warranty deed of Sean Donahue dated February 17, 2006 and recorded February 27, 2006 in Book 215, Page 582 in the Barre Town Land Records. It being a part of all and the same lands and premises conveyed to Sean Donahue by warranty deed of Gregory J. Raymond and Jean R. Raymond, dated December 7, 2004 and recorded in Book 204, Page 595 of the Barre Town Land Records. It being all and the same lands and premises conveyed to Gregory J. Raymond and Jean R. Raymond by warranty deed of Michael J. Booth and Jill K. Booth dated June 24, 1999 and recorded in Book 155, Page 99 of the Barre Town Land Records. This property is subject to the conditions set forth in Land Use Permit No. EC-5-0230, dated May 12, 1976 and recorded in Book 133, Pages 504-505 of the Barre Town Land Records. It is a condition of the said Land Use Permit that the drilled or driven well on the property be located as shown on the plans prepared by Cunningham Associates, Inc., March 1972 and November 1976 and prepared in support of the said Land Use Permit and that the well be no closer than 100 feet from the subsurface disposal system. This conveyance is made subject to and with the benefit of any utility easements, public rights-of-way, spring rights, easements for ingress and egress, and rights incidental to each of the same as may appear more particularly of record, provided that this paragraph shall not reinstate any such encumbrance previously extinguished by the Marketable Record Title Act, Chapter 5, Subchapter 7 of Title 27, Vermont Statutes Annotated. Reference is hereby made to the above-mentioned deeds and all deeds in the chain of title for more particular description of the land and premises herein conveyed. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
