In accordance with the Judgment Order and Decree of Foreclosure entered September 4, 2018, in the above captioned action brought to foreclose that certain mortgage given by Corey Robbins, Eleanor Keeler, Donald Robbins and Christine Robbins to Mortgage Electronic Registration Systems, Inc., as nominee for HomeBridge Financial Services, Inc., dated January 22, 2015 and recorded in Book 45 Page 131 of the land records of the Town of Calais, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for HomeBridge Financial Services, Inc. to HomeBridge Financial Services, Inc. dated June 27, 2018 and recorded in Book 48 Page 729 of the land records of the Town of Calais for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 416 Gosselin Hill Road, Calais, Vermont on June 10, 2019 at 9:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises as conveyed to Corey Robbins, Eleanor Keeler, Donald Robbins and Christine Robbins by warranty deed of Aurelie S. Wood of even or approximate date herewith and to be recorded herewith in the municipal Land Records. Being a parcel of land, said to contain 4.40 acres, more or less, with dwelling house and other improvements thereon standing, now known as 416 Gosselin Hill Road, Calais, Vermont, identified by Calais Parcel ID No. 140416 and Vermont SPAN NO. 120-037-10932. Being all and the same lands and premises as were conveyed to Aurelie S. Wood and James A. Wood, III by warranty deed of David M. Gosselin, Debra Rose, Brinda Gosselin, Maryse Boardman, Aurelie S. Wood, Doreen E. Sewell, Shirelee M. Ladd and Howard C. Gosselin, dated April 17, 2010 and recorded at Book 38, Page 520 of the Calais Land Records, and described therein as follows: "Being a portion of the same land and premises conveyed to David M. Gosselin, Debra J. Gosselin Rose, Brinda Ann Gosselin, Maryse Gosselin Boardman, Aurelie Gosselin Wood, Doreen Elizabeth Gosselin, Shirlee Melissa Gosselin, and Howard Charles Gosselin by quit claim deed of Ronald P. Gosselin and Arlene M. Gosselin, husband and wife, as joint tenants with right of survivorship, dated August 9, 1993, of record at Book 32, Pages 415-416 of the Calais town land records. Aurelie S. Wood and James A. Wood, III (described as James A. Wood in the deed) were formerly conveyed a three acre parcel by Ronald P. Gosselin and Arlene M. Gosselin, David M. Gosselin, Debra J. Gosselin Rose, Brinda Ann Gosselin, Maryse Gosselin Boardman, Aurelie Gosselin Wood, Doreen Elizabeth Gosselin, Shirlee Melissa Gosselin, and Howard Charles Gosselin dated September 10, 1994, of record at Book 33, Page 125 of the Calais town land records. By the present deed, grantors grant Aurelie S. Wood and James A. Wood, III, land adjoining that parcel on the southerly, easterly and northerly sides of their lot. Aurelie S. Wood and James A. Wood, III shall now own all of Lot 3C as shown on the 'Survey of Gosselin Property, Perimeter, Subdivision and Boundary Adjustments for the Gosselin Family, Route 14, Calais, Vermont, by Paul W. Hannan, L.S.," dated April 2010, which survey is to be recorded before or with this deed. Lot 3C contains 4.4 acres more or less. This land and premises is served and burdened by a private road named by the Town of Calais as Gosselin Hill Road, and served and burdened by a shared drive-way, as shown on the Hannan survey running from Gosselin Hill Road through Lot 3B to lands now conveyed to James and Aurelie Wood by this deed. This land and premises are also bound by an Agreement on Road Maintenance, governing the responsibility for maintenance and payment of proportionate expenses on said Gosselin Hill Road. Membership and financial participation ill the Gosselin Hill Road Association, Inc. is a condition of this deed. Said Agreement is of record in the Calais town land records, to be recorded before or at the time this deed is recorded. Lot 3C was authorized by a boundary line adjustment and a subdivision permit granted by the Calais Zoning Administrator dated March 4, 2010, on file in the Calais zoning office. Stephen Beloin, James A. Wood, III, Jean M. Gosselio, Michael S. Boardman, Michael Sewell, Alfred J. Ladd, and Stephanie R. Gosselin join in this deed for the purpose of conveying any rights they may have as spouses of the Gosselin siblings. James A. Wood, III conveyed his interest to Aurelie S. Wood by Quit Claim Deed dated April 3, 2013 and recorded at Book 42, Page 435 of the Calais Land Records. This conveyance is made subject to and with the benefit of any utility easements, public rights- of-way, spring rights, easements for ingress and egress, and rights incidental to each of the same as may appear more particularly of record; provided, however, that this paragraph shall not reinstate any such encumbrance previously extinguished by the Marketable Record Title Act, Chapter 5, Subchapter 7 of Title 27, Vermont Statutes Annotated. If it should be determined that all or a portion of the conveyed lands and premises are Vermont perpetual lease land, then same are conveyed as such. Reference is here made to the above-mentioned deed and survey and to all prior deeds, plans and documents in the chain of title for a more particular description of the herein conveyed lands and premises. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
