Perez, individually and as Trustee of the Albina C. Perez Real Estate Trust to EverBank Reverse Mortgage LLC, dated September 5, 2008 and recorded in Book 248 Page 729 of the land records of the City of Barre, of which mortgage the Plaintiff is the present holder, by virtue of 1) an Assignment of Mortgage from EverBank Reverse Mortgage LLC to Bank of America, N.A. dated March 3, 2010 and recorded in Book 257 Page 923; 2) an Assignment of Mortgage from Bank of America, N.A. to Nationstar Mortgage LLC d/b/a Champion Mortgage dated November 20, 2013 and recorded in book 278 Page 1011; and by 3) Assignment of Mortgage from Nationstar Mortgage LLC d/b/a Champion Mortgage to Bank of America, N.A. dated August 17, 2017 and recorded on October 25, 2017 in book 326 page 337, all of the land records of the City of Barre for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 13 Foss Street, Barre, Vermont on January 21, 2019 at 1:00 PM all and singular the premises described in said mortgage, To wit: Being all and the same land and premises conveyed to Albina C. Perez, Trustee of the Albina C. Perez Real Estate Trust by Quit Claim Deed of Albina C. Perez and David L. Perez, Co-Trustees of the Albina C. Perez Real Estate Trust dated July 17, 2008, of record in Volume 247 at Page 856 of the City of Barre Land Records. Being all and the same land and premises conveyed to Albina C. Perez and David L. Perez Co-Trustees of the Albina C. Perez Real Estate Trust by Quit Claim Deed of Albina C. Perez and David L. Perez dated November 10, 2003 and recorded November 13, 2003 in Volume 208, Page 165 of the City of Barre Land Records. Being a parcel of land, with house thereon, known as 11-13 Foss Street, Barre, Vermont; and being all and the same lands and premises conveyed to Albina C. Perez and David L. Perez by quitclaim deed of Albina Perez dated April 1, 1989 and recorded in Book 138, Pages 919-20 of the Barre City Land Records. Commencing at the southerly corner of the subject premises on the easterly line of Foss St, thence northerly in the easterly line of said Foss St. 75 feet to a stone marker; thence easterly at right angles to said line 110 feet to a stone marker; thence southerly on a line parallel to the line of said Foss St. 75 feet to a stone marker; thence westerly one hundred and ten feet to the point of beginning. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
