Man gets probation for lewd behavior
BARRE — A Graniteville man has been placed on probation for molesting a female relative while watching pornography with her in 2009.
Michael Danilowicz, 38, was sentenced to one to five years, all suspended, 200 hours of community service and was placed on probation in Washington County criminal court Tuesday on a conviction of lewd and lascivious conduct, a felony. Under a plea agreement, the state reduced the charge from lewd and lascivious conduct with a child, which carries a minimum of two years in prison.
The girl said she was home alone with Danilowicz when he asked her to watch pornography on a computer. The girl, who was a teenager at the time, told police she agreed so she could build a relationship with Danilowicz.
Police say the girl watched pornography with Danilowicz two or three times. Twice during those incidents, she reported that Danilowicz touched himself. The girl also told police Danilowicz touched her sexually during the incidents.
In 2012, the girl’s mother was subpoenaed to testify on what she knew about the incident. The mother said the incidents happened in February 2009.
The mother testified that her daughter disclosed the incidents while on the way to school.
The mother then met with her pastor, her daughter and Danilowicz. The woman testified that Danilowicz walked into the meeting, was told of the girl’s allegation, denied it and walked out.
