MONTPELIER — The Vermont Supreme Court has denied 63 state workers who wanted double pay for working while displaced from their offices following Tropical Storm Irene.

The court affirmed an August 2013 decision from the Vermont Labor Relations Board, ruling that the workers weren’t entitled to extra money because the “emergency” situation was technically over a day after the storm.

The Vermont State Employees Association, which represents state workers, had appealed the board decision to the state Supreme Court last July.

Flooding from the storm nearly three years ago closed the state complex in Waterbury and the Department of Motor Vehicles office in Rutland. Employees were forced to work from home or in other makeshift locations.

The employees argued their contract entitled them to double pay, but the state Labor Board and the Vermont Supreme Court on Friday disagreed.

Demolition and site work has been underway for months for construction of a new state office complex that will replace the series of buildings in Waterbury that became unusable after the flooding. The $125 million project includes a new 86,000-square-foot office building, a 20,000-square-foot central plant and the renovation of 13 buildings that were on the site before the flood.

Construction is expected to be completed by the end of 2015, and the building become home to about 900 employees of the Agency of Human Services.
