    to dismiss charges

    BURLINGTON A Vermont police officer accused of shooting a mentally ill man is asking a judge to dismiss the charges.

    Winooski Police Cpl. Jason Nokes argues the state cannot prove beyond a reasonable doubt that he did not act in self-defense or that he acted recklessly when he shot and wounded a suspect in April 2013.

    He has pleaded innocent to a variety of charges.

    He initially told Vermont State Police investigators that he thought Isaac Sage, who had assaulted him on a Winooski street, was carrying a knife. He later admitted he never saw a weapon.

    The Burlington Free Press reports Nokes remains on medical leave due to injuries from the incident.
