• Berlin business is hit with fine

    BERLIN — The owner of a tire recycling business on the Barre-Montpelier Road has been slapped with a $17,000 fine for operating a “solid waste facility” for the past eight years without a permit.

    Fred Budzyn, owner of Budzyn Removal & Recycling in Berlin, was fined $17,301 after Environmental Law Judge Thomas Durkin concluded the discarded tires Budzyn was paid to recycle, reuse or dispose of constituted solid waste.

    Durkin arrived at that conclusion after a one-day trial that capped the state Agency of Natural Resources’ repeated but unsuccessful attempts to persuade Budzyn to resolve the violation by obtaining the certification officials said he needed.

    According to agency officials, Budzyn has since applied for a solid waste certification and it is expected one will soon be issued now that a financial responsibility instrument designed to ensure cleanup of the facility is in place.
