Tool borrowing lands man under arrest
BARRE — A Worcester man is accused of going into another man’s house and taking tools when he wasn’t home.
Joey R. Ewen, 36, pleaded not guilty to felony unlawful trespass of an occupied residence Wednesday in Chittenden County criminal court. If convicted, he faces a maximum of three years in prison and a $2,000 fine.
According to the Vermont State Police affidavit, Craig Cane, of Worcester, called state police Tuesday to say that two of his power tools were missing. Cane told state police that Ewen had taken a Sawzall and a Rotozip tool from Cane’s home and had left a note saying, “Crig I needed to barrow your sawall and Rotor Joey Bring Back ASAP.”
When state police arrived at Cane’s home on Elmore Road, Cane showed state police the note and the empty case that had contained the tools. Cane told state police that he leaves his front door unlocked and has never had to lock it in his entire life.
Cane told state police that he had bought the tools from Ewen for $250. He said he could not pay for the tools all at once and had set up a payment plan with Ewen. Cane told state police he still owed $35 for the tools and tried to pay Ewen the remaining money Sept. 13 but that Ewen failed to meet him.
State police said Ewen told them he had gone into Cane’s home and taken the tools. Ewen told state police he did not think he did anything wrong because Cane still owed him money for the tools and he and Cane were “buddies,” according to the affidavit.
Ewen went back to Cane’s home, followed by state police, gave the tools back to Cane and was arrested.
Ewen has a lengthy criminal record with 18 misdemeanor convictions, including attempting to elude an officer in 2006, negligent operation in 2006 and 2001, passing a bad check in 2004, driving under the influence in 2004 and 2000, two convictions of petit larceny in 2003 and retail theft in 1994.MORE IN This Just InRANDOLPH — The Conservation Law Foundation and Vermont Natural Resources Council sought...
