Driver with 4 DUIs crashes, sends 4 to hospital

BARRE – A Williamstown man with a lengthy record of driving under the influence and without a license was allegedly caught doing both following a Sunday evening accident on South Main Street.

Less than 24 hours after the head-on collision that sent four others – three of them children – to the hospital, Eric Russell, 31, pleaded innocent to his fourth DUI, as well as a related charge of grossly negligent operation of a motor vehicle with serious injury resulting.

Both charges are felonies for which Russell, if convicted, could be sentenced to up to 15 years in prison, fined up to $5,000 and $15,000 respectively, or both.

Police said Russell's blood alcohol content was nearly three times the legal limit when the accident occurred.

Monday's arraignment occurred even as the driver of the other car, William Peterson, 40, of Barre, was recovering from what Kelly described as the first in what will likely be a series of surgeries on his leg.

"That left leg was just decimated," he said, explaining the femur was shattered and the knee, shin, heel and two toes were all broken.

Peterson, who also suffered a fractured sternum and a head injury in the accident, was initially transported to Central Vermont Medical Center in Berlin and later transferred to Fletcher Allen Health Care in Burlington.

Three children traveling in Peterson's car – 13-year-old twins Ty and Logan Avery and Shyla Peterson, 7 – were also taken to the hospital with assorted injuries. According to Kelly, it took 12 staples to close a head laceration suffered by Ty Avery, while his brother suffered a back injury and foot sprain. The younger Peterson escaped with bumps and bruises.

Court records indicate Russell, whose blood alcohol content was .259 – more than three times the legal limit – nearly an hour after the accident, may have suffered a mild concussion.

Washington County States Attorney Tom Kelly said Russell, who lost his license for life following his third DUI conviction five years ago, will likely be charged with driving while under suspension for a seventh time.

Citing Russell's lengthy record, the likelihood he is looking at serious jail time if convicted and the severity of the injuries sustained by occupants of the northbound car he allegedly plowed into shortly before 8:30 p.m. Sunday, Kelly asked Judge Brian Grearson to consider setting cash bail in the case.

"He (Russell) has not followed the rules of either the court … or the (state) Department of Motor Vehicles," Kelly said, grudgingly conceding Russell's "strong ties to the community."

Jeffrey Wilson, Russell's court-appointed lawyer, urged Grearson to take those ties into consideration when deciding whether to impose cash bail. He argued that Russell, a self-employed carpenter, could not afford to post bail and pay his bills.

"Money is extremely tight," he said, noting that Russell has never run from any of his earlier offenses.

"I would argue he (Russell) has no where else to go," Wilson said.

Grearson acknowledged as much.

"You're still here," he told Russell. "We continue to be plagued with you allegedly driving without a license."

Grearson opted not to set bail – choosing instead to release Russell on a host of conditions, including one that will require him to report daily to the Barre Police Department and another that imposes a 6:30 p.m. to 6 a.m. curfew. Grearson ordered Russell not to drive or drink and instructed him to immediately enroll in substance abuse counseling.

Police, who were summoned to the scene of the accident in front of Lazer Wash on South Main Street at 8:30 p.m. Sunday, said when they arrived they found Russell's gray Ford Ranger pickup truck and Peterson's black Volkswagen Gulf locked together.

According to police, Russell who was heading south at the time, apparently swerved into the northbound lane slamming into Peterson's oncoming car.

Although both vehicles sustained extensive front-end damage, Kelly said Peterson's car and its occupants clearly got the worst of the exchange.

"His (Peterson's) car was no match for Mr. Russell's truck," Kelly said.

Russell, a 1996 graduate of Spaulding High School, was fined $200 when he was first convicted of DUI in 1998. Following his second DUI conviction in 2000 he served 10 days in jail as part of a suspended sentence of six months to two years. Russell was sentenced to one to five years following his third DUI conviction – a felony – in 2003.

Had this person been drunk, standing on South Main St. and waving around a gun, and injured 4 people with gunfire, what would the charges be? Driving a motor vehicle, drunk is just as dangerous - and this person is a repeat offender. It does seem like prison is the only way to keep a repeat attempted murderer from continuing to use his weapon of choice.

As to community ties - It sounds like a number of those commenting are in the local community, and the community says -- tie this one up.

Judge Grearson, what do you suppose ole 4th DUI/ 7th DLS Eric is doing tonight? How about tomorrow night? How about this weekend? Do you honestly believe because you told him not to drink and drive that he won't? Wake up man! The real world IS out there! And ole Eric is drinkin' and drivin' in it.

The legislature needs to tighten up the laws for drunk drivers just like they do for child molesters. It seems like there always has to be a dead body first,,, then things will change. One thing that won't change is this moron. He will continue to drink. He will continue to drive. He DOES - NOT - CARE ! Only a complete idiot would believe he will change. He doesn't need substance abuse counseling. He's had it. It doesn't work for everyone. It did not work with him. It WILL NOT do any good to send him to a CDAC or to AA meetings. He does not want to change. The legislature needs to produce a mandatory minimum law for drunk drivers like this. This judge is a pushover. Why should he EVER see freedom again?

Owlcat, i gotta question for you???/ is it lonely up there on the self-righteous podium that your sitting on....?... for gods sake man remove your head from your sphincter, This is Eric Russel's 4th DUI and its obvious that he has no intention on changing his ways? This man deserves to be locked away for life!!!!

On a seperate note, I talked to Mr. Peterson's mother today and the news is that he has taken a turn for the worse. the doctors have put hin in a medical coma, and their trying to stop his internal bleeding.

So with that out there, do you think Eric Russel should still be allowed to be on the streets owlcat?

Finally this is not a personal attack on anyone, I'm just addressing ignorance(which seems to be at a super amount right now)

Bob, you completely missed the point - Depending on circumstances, yes if it were my kids/wife whatever i may feel differently - My point is that you can't have your Jails, and fill them too...

People here constantly complain about people being let out early, yet they also complain that they aren't locked up soon enough.

Case in point - do you see any new jails being built to accomodate more prisoners? .... I rest my case...

As for money tight for him....well i hate to say it money is tight for everybody, so what makes his financial situation any worse off than the rest of us???? Seriously. If it was anybody else the judge woulda slapped with primo jail time and a monster sized bail fee, so just because this guy has "strong community ties" he just gets a slap on the hand....something stinks in the land of OZ(so to speak)

Is just a slap on the hand really necessary? This man has had MULTIPLE charges of DUI. Therefore, WHY is he NOT in jail? Is there some reason we let individuals like this run free and lose, and then wonder why they screwed up again? Obviously this guy has a problem with alcohol and needs a little more help than he's been getting.
This case should really go to re-trial and a stronger conviction should be made. Honestly, this is riddiculous.
I'm sure once he finally hits somebody and kills them while driving drunk, then people will get their heads out from under the sand.
I, for one, am NOT impressed.

Letting him get out to drive and roam the town and roads again is ludicrus. If it had been Mr. Petersen who had been drinking and hit Russell's vehicle he would have been in the lockup for days. And since when do "strong ties to the community" mean more than the law?????? Never did when I was growing up so why now?? What about Mr. Petersen's mother who now has no vehicle since it was her car that was just destroyed by Russell? Does he give a darn...heck no!!! Betcha right now he has a bottle and is drunker than a skunk!!! Let's put him away for a while so that he will not get the chance to drink and drive again and maybe kill somebody.

He intentionally drove without a license while extremely intoxicated. Charges of attempted murder and aggravated assault should be filed. This man has had more than
his share of chances to change his behavior.

Eric Russell - Karma - What comes around goes around! Enjoy Jail, that is where He belongs! this is your 4th time caught, we all know there has been many more. You drive every day. He is a person with some serious issues, not just drinking. He needs help..give him more than alchohol counseling..

No money for bail?? Money to drink though.. The judge will find out about his unstablility and what risk he is to himself and now others, especially children...directly or indirectly. Good luck with this one. He is reaching out for some much needed intervention..give it to him! I am synpathtic to the victims.. not him.. These people dont stop. Our court system needs to change some of thier ways. He has ties because he was born here, and has never been a productive Barre citizen, belive me I know....I wish I could say more.

Not that I like being the person to defend the honour of the DMV, but I do feel compelled to not let them be erroneously maligned.

The DMV isn't authorized to "deal" with these people as G Murphy puts it. The DMV can only follow the letter of the law (not the intent), no matter how wrong headed or myopic. It is up to the legislature to write the laws; it's up to the DMV to correctly enforce those rules.

I have no sympathy for a repeat DUI offender and just as little patience with a system that allows it to occur...just in case anyone thinks I'm defending anyone :)

This person is what is known by the judicial system and substance abuse professionals as a hardcore drunk driver. Hardcore drunk drivers is defined as people who repeatedly drive when their BAC is over .15. The DMV and the legislature has repeatedly refused to deal proactively with these people. There are three ways to deal with such people: incarcerate them for life with no chance at parole; execute them or get them to stop drinking. The first would require taxpayers to finance their room and board and the second is not politically feasible. The third is something that the state could take affirmative steps to achieve. Any hardcore drunk driving should be required by law to be abstinent from alcohol and should be continually required to provide proof of abstinence. I have submitted proposals to the legislature which would take steps in the third direction. I have been told by several legislators that this is a good idea but they are either to afraid of the pushback by groups such as the mad mothers or state that the legislature has other more pressing matters to take it up. I have talked with and sent information about the problem to Bill Lippert and his latest response to the problem is to propose lowering the limit to .05. Given that it has probably been years since Russell's BAC has been below the current level of .08 so I don't know how Lippert thinks that lowering the limit even further is going to address the problem of the hardcore drunk driver. Until the legislature enacts one or more of the measures I mentioned above, the problem of the hardcore drunk driver will persist and we will continue to see articles like this in the news.

The judge is wrong. This guy is a clear and present danger. He should be held without bail. It's not about if he will show up at his court hearings. It's about the fact this guy will continue to drink and drive.

Judge Grearson: This guy is going to continue to drink and drive. Don't you get it????????!!!!!!

4th D.W.I., Serious injuries to Victims, Bail for for Russell Have MERCY on Him your Honor, Money is tight,Sure,Cant afford bail , but he had money to drink though!. 10 years in Prison Might dry him out.
